1. Scoop
The general terms and conditions – online shop (hereinafter referred to as “Terms and Conditions”) cover all legal transactions that are concluded via the online shop www.chiza.ch (hereinafter referred to as “chiza.ch”). This online shop is run by Lukas Steiner. chiza.ch reserves the right to change these General Terms and Conditions at any time. The version valid at the time of the order applies.
2. Offer
The products and prices in the online shop are considered an offer. The offer is valid as long as the product can be found in the online shop and is in stock. Only people who have reached legal adulthood in the target country are eligible to purchase.
3. Products, prices and payment methods
chiza.ch can set the prices freely and change them at any time. When ordering, the price published on the website applies. If prices have been published in error, chiza.ch reserves the right to inform the buyer (hereinafter referred to as the “buyer” or “customer” for improved reading flow) before shipping in order to agree on a price correction or to accept the order cancel.
Certain prices can be freely selected within a range. If a product is purchased at a lower price than the recommended price, it is considered a reduced offer and is excluded from the right of withdrawal.
The prices are stated in CHF as standard.
The shipping and packaging costs are calculated and shown separately from the offer price. Any cash on delivery charges incurred by the selected logistics partner are entirely at the customer’s expense.
The payment methods listed on the “Checkout” page are available.
4. Bereitgestellte Informationen
chiza.ch endeavors to keep the data published in the online shop up to date and correct. However, delivery delays may occur due to production/delivery bottlenecks and sales via other channels. Therefore, all information regarding availability and delivery times is without guarantee and can change at any time.
chiza.ch assumes no liability for the accuracy or topicality of the information provided by other manufacturers, even if it has been carefully researched.
5. Conclusion of contract
The purchase contract is concluded when the order is sent (online) and accepted by chiza.ch.
The prerequisite for a valid purchase contract is the complete and truthful completion of the order form provided on the Internet and the acceptance of the General Terms and Conditions – Online Shop.
chiza.ch confirms receipt of the order with an automatically generated order confirmation by email. This simply shows the customer that the order has arrived and that the purchase contract has been concluded on the condition that delivery is possible and that the price is correct.
6. Delivery conditions and collection
6.1 Availability and delivery
Products marked as “available” are usually delivered within 1 – 3 working days from receipt of the order. There is no shipping on Saturdays and Sundays. If a product is not in stock or incorrectly marked as “available”, the customer will be informed of this by email or telephone and a new provisional delivery or collection date will be agreed. chiza.ch endeavors to ensure rapid delivery and sends back goods without additional shipping costs.
If an item is no longer available and can no longer be procured or produced by chiza.ch, chiza.ch can withdraw from the contract, but must fully refund the customer any payments already made for the product in question.
If chiza.ch is unable to provide or ship the items within 30 calendar days of receipt of the order, the customer has the right to withdraw from the contract. Payments already made by the buyer to chiza.ch for the product in question will be fully refunded. There are no further claims against chiza.ch.
If additional shipping costs arise due to an incorrect delivery address or incorrect address details, these costs will be borne entirely by the buyer.
Unless otherwise agreed, chiza.ch ships national and international orders with Swiss Post. The Swiss Post regulations, information and delivery times apply.
6.2 Delivery conditions special orders
Products that are not listed in the chiza.ch online shop and may require a procurement time of more than 30 calendar days are considered special orders. Delivery times and dates for special orders are agreed between chiza.ch and the customer in writing or verbally.
6.3 Additional provisions for delivery
If the customer does not accept the goods delivered by the supplier within the agreed or stated delivery times, chiza.ch can withdraw from the contract, cancel the order and charge the customer a processing fee of 20%, but at least CHF 30. Fees incurred by third parties (payment processors) as part of the order will not be refunded.
7. Obligation to inspect
The delivered or collected products must be checked by the buyer immediately after acceptance for completeness, accuracy and delivery damage. If there is a defect, chiza.ch must be notified of this within 7 calendar days and the product must be in its original condition to be returned.
8. Guarantee conditions and services
chiza.ch produces goods or sells items from other manufacturers. Chiza.ch has no influence on the durability and functionality of the products or the guarantee provided by other manufacturers. The manufacturer’s guarantee information therefore applies, provided that it is valid in Switzerland.
Otherwise, the Swiss statutory warranty provisions apply in accordance with Art. 197 ff. OR.
A warranty claim can only be made by the customer upon presentation of the purchase contract including a valid order form.
There is no warranty claim for damage caused by improper handling or for defects that can be traced back to external influences. This could be, for example, natural damage, moisture damage, fall and impact damage or damage caused by modifications.
Chiza.ch can provide the warranty service by replacing the product as new.
9. Liability and exclusion of liability
Chiza.ch is only liable for the guarantee services listed under section 8. Any further liability is excluded, in particular liability for damage that did not occur to the products themselves. These can be indirect and indirect damages and consequential damages such as lost profits, unrealized savings, or damages from late delivery. Furthermore, Chiza.ch is not liable for damage (to people, other organisms and/or goods) caused by improper storage or handling.
10. Payment
The invoice (for goods, services or virtual products) must be paid in the currency specified therein and immediately upon or after submitting the order. The following payment methods are accepted in the online shop: credit cards via the payment platform zahls.ch (Mastercard, Visa, American Express), PayPal transfers, TWINT (only in CHF).
11. Data Protection
Chiza.ch only collects personal data that is necessary to conclude the contract. These will not be processed further without the buyer’s separate consent.
The data will only be passed on to third parties if this is necessary to process the order. This affects the logistics partner for home delivery and the credit institution for payment processing.
12. Copy Rights
The content of this website is protected by copyright and it is prohibited to copy and/or reuse content such as texts – including these General Terms and Conditions -, layout or images.
13. Application of law and place of jurisdiction
The relationship between Chiza.ch and the customer is subject exclusively to Swiss law. The place of jurisdiction is Aarau, Switzerland.
